This GLUXUS Health Privacy Notice explains the privacy practices of GLUXUS Inc., a company incorporated under the laws of Canada and headquartered at Maple, Ontario, CANADA (together “GLUXUS,” “we,” “us,” “our”) with respect to the information collected through the GLUXUS Health application, connected applications and associated accessories (“GLUXUS Health”).

If we update this Privacy Notice, the new terms will be notified to you by email (if you have a GLUXUS account) or displayed on-screen and you will be required to read and accept them to continue your use of GLUXUS Health.

You can determine when this Privacy Notice was last revised by referring to the “Version” at the top of this page.

1. WHAT INFORMATION IS SHARED WITH US?
If you use GLUXUS Health without logging in to your GLUXUS account, we collect and store the following information that you provide directly or generate through your use of GLUXUS Health:
o birth year
o gender
o height, weight and activity levels
o device information including identifiers
o firmware version of device
o application version and major setting values for the GLUXUS Health application
o in-app usage information (menus and settings clicked, features used (frequency and duration of use), and any errors displayed)

If you use GLUXUS Health social networking service via our communication feature “Enhanced Features”, we may collect and store the following additional information so that you and other users you select can share each other’s profiles and activity logs:
o phone number
o nickname, profile image, birthday, country
o steps, burned calories, distance and other activity logs

If you use GLUXUS Health while logged in to your GLUXUS account, we may collect and store the following additional information that you provide directly or generate through your use of GLUXUS Health:
o connected accessories make, model, identifiers (MAC address, Android ID, serial number)
o third party application identifier (package name)
o profile and activity-related information such as user name, date of birth, profile photo, postings
o fitness and nutrition-related information such as exercise information (types of exercises, exercise programs, type of steps, speed, moving distance, etc.), food, caffeine and water intake
o wellness-related information such as heart rate, ECG, body fat, skeletal muscle, muscle mass, basal metabolic rate, blood glucose level, blood pressure level, blood oxygen (SpO2) level, hemoglobin (HbA1c) level, stress level and sleep-related information. Please note that such wellness-related information can reveal your state of health and can therefore consist of sensitive personal data.
o location information (where you are using location-based features and location settings have been activated on your device)

2. WHAT WE DO WITH THE INFORMATION WE COLLECT
We use this information to provide services or features that you request, including data back-up and sync services for GLUXUS account users, to offer customized content and recommendations, and to provide optimized service combined to compatible GLUXUS services. We may also conduct data analysis and statistics to improve our services.

When you use GLUXUS Health with third party applications, you may choose to share or synchronize your information with such services and applications. We will grant access to such other services and third-party applications only when you authorize us to do so.

With your consent, we may send promotional push notifications to your mobile device (you can change your notification settings at any time in the settings menu of GLUXUS Health application).

We use a variety of standard security measures, including encryption and authentication tools. When you access information, we offer the use of a secure server.

3. TO WHOM DO WE DISCLOSE YOUR INFORMATION?
We will not disclose your information to third parties for their own independent marketing or business purposes without your consent. However, we may share your information with our affiliates and service providers (as data processors) as necessary for the purposes of providing the GLUXUS services and features as described above in Section 2. We may also disclose your information to a third party where we have a legal obligation to do so.

4. CONSENT TO INFORMATION ABOUT INTERNATIONAL TRANSFERS
By ticking the ‘I agree’ box below, you consent to the collection, transfer, storage and processing of your information (collected by GLUXUS Health) outside of your country of residence (including, in particular, Canada), consistent with and for the purposes described this Privacy Notice. Please note that the data protection and other laws of countries to which your information may be transferred might not be as comprehensive as those in your country.

5. HOW TO ACCESS YOUR INFORMATION
You may view and edit (including to correct, complete, clarify or erase) the information we collect using the GLUXUS Health application. You may also have statutory rights to access and edit such information and you have the right to request information about your personal data. Furthermore, you may refuse the disclosure of your information to a third party at the moment the information is collected. 6. HOW TO DELETE YOUR INFORMATION
When you delete the GLUXUS Health application, the information saved in your device will be deleted but any information collected and stored by us will still remain in our GLUXUS Health server. If you want to delete the information collected through GLUXUS Health from both the device and our GLUXUS Health server, you can do so by going to Settings and selecting Reset Data. However, any third-party applications you have authorized us to share or synchronize your information with may continue to store your information subject to their own privacy policies and practices.

By selecting ‘I agree’, you confirm that you have carefully read and understood all terms and conditions of this Privacy Notice, and you hereby give your consent to the collection, use, storage, sharing, disclosure and other processing of your personal data, including your sensitive personal data, in accordance with the terms set forth in this Privacy Notice.
